10:10 AM PST - Microsoft has been working on its appeal from day one.
What has been very clear from the beginning was that Microsoft will
force all consumers to buy all Microsoft products even if it means going
to court to help force it. It
is an attitude problem. It is an arrogance. It is an absolute
refusal to give consumers a choice of which products they buy and which
products they do not buy.

10:20 AM PST - Settlement talks underway?
Once Microsoft realizes privately that they are going to lose this one, they may decide to cut a deal. It might make sense for them to do that. But, I am not sure the DOJ is going to go along. Microsoft and the DOJ have already come to one agreement regarding this issue (I.E. the consent decree written by Judge Jackson himself).
The problem is that Microsoft entered into that agreement knowing they could just ignore it completely.
I am not certain that either the DOJ or the court is willing to accept
any representations made by Microsoft or it's counsel at this point regarding
what they will or will not do voluntarily.
